By accessing or using DraftTally ("the Service"), operated by DraftTally LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
DraftTally is a cloud-based software-as-a-service (SaaS) platform for managing barge draft surveys. The Service allows users to create digital draft survey worksheets, capture six-point draft readings and tank soundings, calculate cargo weights, export professional reports in Excel and PDF formats, and manage survey teams and client records.
You must register for an account to use the Service. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
Organization administrators may invite additional users, assign roles, and manage permissions within their organization. Each organization's data is isolated and accessible only to its authorized members.
Certain features of the Service require a paid subscription. By selecting a paid plan, you agree to pay the applicable fees as described on our pricing page. Subscription fees are billed in advance on a monthly basis and are non-refundable except as required by law.
We reserve the right to change our pricing with 30 days' notice. If you do not agree to the new pricing, you may cancel your subscription before the next billing cycle. Payment processing is handled by Stripe, Inc. We do not store your full credit card information on our servers.
The Service, including its original content, features, and functionality, is owned by DraftTally LLC and is protected by copyright, trademark, and other intellectual property laws. You retain all rights to the survey data and content you create using the Service. By using the Service, you grant us a limited license to host, store, and process your data solely for the purpose of providing the Service to you.
You agree not to use the Service to: violate any applicable law or regulation; infringe upon the rights of others; transmit malicious code or interfere with the operation of the Service; attempt to gain unauthorized access to any part of the Service; or use the Service for any purpose other than its intended use as a draft survey management tool.
To the maximum extent permitted by applicable law, DraftTally LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service.
Our total liability for any claims arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim. The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.
You may terminate your account at any time by contacting us or using the account settings within the Service. We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will cease immediately. You may request an export of your data within 30 days of termination.
These Terms shall be governed by and construed in accordance with the laws of the State of Louisiana, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Louisiana.
